Grounds for an Analytical Reconstruction of the Legal Dogmatics Conceptual Ontology of Procedural Law.

The aim of this paper is to criticize the metaphysical and essentialist epistemic assumptions of legal dogmatics and how it produces its conceptual ontologies. It proposes an alternative analytical methodology based on the supra-rule theory. The itinerary of the research is as follows: 1) we elaborated a corpus from the digital version of the main books on dogmatics of procedural law through the MAXQDA software; 2) from the data yielded, we obtained a sample of conceptualisations identification of patterns of epistemic assumptions and strategies followed for the authors of conceptualization; 3) the writing begins with a brief consideration of the epistemic and essentialist assumptions of legal dogmatics; 4) brief description of the analytical turn in philosophy; 5) semantic considerations of the term “legal dogmatics”; 6) demonstration of the metaphysical and essentialist patterns resulting from the analysis of conceptualisations; 7) presentation of the Suprarule Theory; 8) methodological proposal for the analytical reconstruction of the conceptual ontology of the dogmatics of procedural law, based on the Suprarule Theory; and 9) Conclusions.

Bicentenary of the Promulgation of the Constitution of 1824 and its Comparison Against other Constitutions of the Time

This article refers to the Constitution of Mexico of 1824 in comparison with other key constitutions of its time, such as that of the United States, France, Cádiz and Gran Colombia. Although all of them obey the historical context of each country as revolutions and the redefinition of political power, in the particular case, the Mexican Constitution was influenced by the federalist model of the United States, which sought to balance power between the central government and the states, but faced great challenges due to deep social and regional divisions where the influence of the Church and territorial fragmentation complicated the implementation of federalism. Finally, the text explores the differences between these constitutions in terms of individual rights and the relationship between religion and the State with the aim of highlighting how each nation adapted these principles to its specific context and how, in the case of Mexico, the Constitution of 1824 represented an attempt to modernize the political structure without losing sight of the complex local realities.

As there are abundant studies on the subject, the development of the work is carried out from the analysis of the most relevant judicial decisions, considering that it is the most appropriate way to approach the concept in question.

The challenges faced by fiscal federalism are also addressed, such as double taxation and economic disparities between regions, as well as the need to implement effective fiscal coordination, an essential element to overcome the obstacles inherent in fiscal federalism and guarantee efficient and equitable management of public resources.
